How an estoppel statement fits into your timeshare closing
For a timeshare closing, the useful question is whether the resort’s status statement agrees with the purchase terms. Reconcile the exact interest, included usage and balances, then resolve discrepancies before the relevant transaction deadlines.
Work through a discrepancy list
- A different owner or interest description needs clarification by the responsible professional.
- A different usage balance needs an agreed explanation or written adjustment.
- A later charge needs a clear allocation between the parties.
- A membership question outside the statement needs separate program confirmation.
Before signing or depositing money
Ask what evidence supports the seller’s ownership and available use. Identify whether the proposed sale includes current-year points, banked usage or a reservation, and how the agreement addresses any discrepancy.
When the statement arrives
Have the responsible closing professional compare owner names, interest description, balances and usage with the purchase terms. Ask how later fee invoices, assessments or usage changes will be handled before completion.
At completion
Review the final allocation of charges and credits. Obtain the transfer/recording confirmation appropriate to the product and retain the supporting documents. Ask whether any program account or benefit question remains unresolved.
Limits of the document
A resort statement is not a substitute for legal/title advice where needed. Do not assume the same contents, fee or validity period applies to another club or jurisdiction.
A useful follow-up question
What if the statement and listing disagree?
Ask the agent and closing provider to identify which information is current and how the written transaction should address it. Do not silently substitute an assumption. The agreement, current supporting records and any necessary amendment should tell a consistent story.
